مقدمة

مرحبًا بك في 7FITNESS.

تنظم هذه الشروط والأحكام استخدامك لموقع 7FITNESS وتطبيقاتها ومنصاتها الرقمية وخدماتها وبرامجها وعضوياتها ومرافقها، وأي خدمات أو منتجات أو مزايا أخرى تقدمها 7FITNESS من خلال قنواتها المختلفة.

باستخدامك أيًا من خدمات 7FITNESS أو تسجيل حساب أو الاشتراك في عضوية أو شراء منتج أو خدمة أو الاستفادة من أي من المزايا المتاحة، فإنك تقر بأنك قرأت هذه الشروط والأحكام وفهمتها وتوافق على الالتزام بها، بالإضافة إلى سياسة الخصوصية المعمول بها لدى 7FITNESS، وذلك بالقدر الذي لا يتعارض مع الأنظمة واللوائح المعمول بها في المملكة العربية السعودية وفي حال عدم موافقتك على أي من هذه الشروط، فيجب عليك عدم استخدام الخدمات أو الاستفادة منها ولا يترتب على قبول هذه الشروط التنازل عن أي من الحقوق التي تقررها الأنظمة المعمول بها للمستخدم أو المستهلك.

أولًا: التعريفات

لأغراض هذه الشروط والأحكام، يكون للكلمات والعبارات التالية المعاني الموضحة أمام كل منها ما لم يقتضِ السياق خلاف ذلك:

7FITNESS: العلامة التجارية والمنشأة المشغلة للخدمات والمنتجات والبرامج والمنصات التابعة لها.
الخدمات: جميع الخدمات والبرامج والعضويات والمزايا والمنتجات والمحتوى والخصائص التي تقدمها 7FITNESS من خلال موقعها أو تطبيقاتها أو مرافقها أو أي قناة رقمية أو تشغيلية تابعة لها.
المستخدم: كل شخص يستخدم موقع أو تطبيق أو خدمات 7FITNESS، سواء كان مسجلًا أو غير مسجل.
العضو: المستخدم الذي قام بالتسجيل أو الاشتراك في إحدى العضويات أو البرامج التي تقدمها 7FITNESS.
الحساب: الحساب الإلكتروني الخاص بالمستخدم والمسجل لدى 7FITNESS.
المحتوى: النصوص والصور والفيديوهات والتصاميم والمواد التدريبية والبرامج والمعلومات والبيانات وأي مواد أخرى يتم عرضها أو إتاحتها من خلال الخدمات.

ثانيًا: الأهلية واستخدام الخدمات

يشترط لاستخدام الخدمات أن يكون المستخدم مستوفيًا للأهلية النظامية اللازمة لإبرام هذه الاتفاقية.
تكون خدمات 7FITNESS متاحة للأشخاص الذين تبلغ أعمارهم 16 عامًا فأكثر، ويجوز لمن هم دون 16 عامًا استخدام خدمات 7FITNESS بموافقة ولي الأمر، وذلك وفقًا للأنظمة والضوابط المعمول بها.
يلتزم المستخدم بتقديم بيانات صحيحة ودقيقة ومحدثة عند التسجيل أو الاشتراك أو استخدام الخدمات.
يتحمل المستخدم مسؤولية المحافظة على سرية بيانات الدخول إلى حسابه، ويتحمل المسؤولية عن الاستخدام الذي يتم من خلال حسابه، ما لم يثبت أن الاستخدام تم نتيجة سبب خارج عن إرادته.
لا يجوز للمستخدم إنشاء حساب باسم شخص آخر أو انتحال شخصية أي شخص أو جهة أو الادعاء بوجود علاقة أو تمثيل أو ارتباط بـ 7FITNESS دون تصريح.
لا يجوز للمستخدم تمكين شخص آخر من استخدام عضويته أو حسابه إذا كانت العضوية شخصية أو غير قابلة للتحويل.
يحق لـ 7FITNESS اتخاذ الإجراءات اللازمة عند اكتشاف استخدام غير مصرح به للحساب أو العضوية أو مخالفة هذه الشروط.

ثالثًا: الاستخدام المقبول

يلتزم المستخدم باستخدام الخدمات بطريقة نظامية ومشروعة، ويحظر عليه:

استخدام الخدمات لأي غرض غير مشروع أو مخالف للأنظمة واللوائح المعمول بها في المملكة العربية السعودية.
إدخال أو نشر معلومات غير صحيحة أو مضللة أو منتحلة.
إساءة استخدام الخدمات أو محاولة تعطيلها أو التأثير على أدائها أو أمنها.
محاولة الوصول غير المصرح به إلى حسابات المستخدمين أو الأنظمة أو الخوادم أو قواعد البيانات التابعة لـ 7FITNESS.
استخدام برامج أو أدوات آلية أو وسائل تقنية بهدف استخراج أو نسخ أو جمع محتوى أو بيانات من الخدمات دون موافقة كتابية مسبقة من 7FITNESS.
نسخ أو إعادة نشر أو توزيع أو استغلال محتوى 7FITNESS تجاريًا دون الحصول على موافقة مسبقة.
نشر أو تحميل أي محتوى يتضمن تشهيرًا أو تهديدًا أو إساءة أو تحريضًا أو انتهاكًا لحقوق الغير أو مخالفًا للأنظمة.
استخدام الخدمات بطريقة قد تؤدي إلى الإضرار بـ 7FITNESS أو مستخدميها أو موظفيها أو شركائها أو أي طرف آخر.
محاولة تجاوز أي إجراءات تقنية أو أمنية وضعتها 7FITNESS لحماية الخدمات أو المستخدمين.
استخدام الخدمات أو المحتوى المتاح من خلالها لتقديم خدمات منافسة أو إعادة بيعه أو استغلاله تجاريًا دون موافقة كتابية.

رابعًا: العضويات والاشتراكات

تخضع العضويات والاشتراكات للأسعار والمزايا والمدة والشروط الموضحة للمستخدم وقت الاشتراك.
تبدأ مدة العضوية أو الاشتراك من تاريخ التفعيل المحدد عند إتمام عملية الاشتراك، ما لم يوضح خلاف ذلك.
تكون العضوية شخصية ولا يجوز نقلها أو بيعها أو مشاركتها مع الغير، إلا إذا سمحت 7FITNESS بذلك صراحة.
قد تختلف مزايا العضويات والبرامج بحسب نوع الاشتراك والباقات والعروض المتاحة.
يجوز لـ 7FITNESS تقديم عروض أو مزايا مؤقتة أو برامج ترويجية وفقًا للشروط الخاصة بكل عرض.
لا يجوز الجمع بين العروض أو الخصومات إلا إذا نصت شروط العرض صراحة على ذلك.
لا يعني انتهاء العضوية أو إلغاؤها أحقية المستخدم تلقائيًا في استرداد جميع المبالغ المدفوعة، وتخضع عمليات الإلغاء والاسترداد للشروط المعلنة عند شراء الخدمة والأنظمة ذات العلاقة.
في حال كانت العضوية قابلة للتجديد التلقائي، يتم إشعار المستخدم بذلك عند الاشتراك، وتطبق آلية التجديد والإلغاء الموضحة في الخدمة.

خامسًا: المدفوعات والأسعار والضرائب

يلتزم المستخدم بسداد قيمة الخدمات أو المنتجات أو العضويات وفق الأسعار المعلنة وقت إتمام عملية الشراء.
جميع الأسعار تكون بالريال السعودي، ويُوضح للمستخدم ما إذا كانت الأسعار شاملة لضريبة القيمة المضافة أو خلاف ذلك أو أي رسوم أخرى، وفق المتطلبات النظامية.
يتم تنفيذ عمليات الدفع من خلال وسائل الدفع المتاحة والمعتمدة لدى 7FITNESS أو مزودي خدمات الدفع.
لا تتحمل 7FITNESS مسؤولية أي فشل في عملية الدفع يعود إلى البنك أو مزود خدمة الدفع أو وسيلة الدفع المستخدمة من قبل المستخدم، متى كان ذلك خارجًا عن سيطرة 7FITNESS.
يحق لـ 7FITNESS تحديث الأسعار أو الباقات أو المزايا المستقبلية، على أن تسري الأسعار الجديدة على عمليات الشراء أو التجديد اللاحقة، ما لم تقتضِ الأنظمة خلاف ذلك.
يتم إصدار المستندات والفواتير الضريبية وفق المتطلبات النظامية المعمول بها في المملكة العربية السعودية.

سادسًا: الإلغاء والاسترداد

تخضع عمليات إلغاء العضويات والاشتراكات والخدمات واسترداد المبالغ للسياسة المعلنة لكل خدمة، وللأنظمة واللوائح ذات العلاقة.
في حال وجود حق نظامي للمستخدم في الإلغاء أو الاسترداد، فلا تؤثر هذه الشروط على ذلك الحق.
إذا كانت الخدمة قد بدأت بناءً على طلب المستخدم وقبل انتهاء المدة النظامية المقررة للعدول أو الإلغاء، فقد تطبق الأحكام النظامية المتعلقة بالخدمات التي بدأ تنفيذها، بحسب طبيعة الخدمة.
يتم رد المبالغ المستحقة -إن وجدت- من خلال وسيلة الدفع الأصلية أو أي وسيلة أخرى متاحة وفق الإجراءات المعتمدة.
قد يستغرق تنفيذ عملية الاسترداد ان وجدت مدة لا تقل عن (15) يوماً بسبب إجراءات البنوك أو مزودي خدمات الدفع.

سابعًا: الخدمات الرياضية والبرامج التدريبية

تقدم 7FITNESS برامج ومحتوى وخدمات مرتبطة باللياقة البدنية والتمارين والنشاط البدني وفق طبيعة كل خدمة.
قد تتضمن بعض الخدمات برامج أو توصيات أو محتوى يتم تخصيصه بناءً على المعلومات التي يقدمها المستخدم أو البيانات التي يسمح بجمعها ومعالجتها.
يتحمل المستخدم مسؤولية تقديم معلومات صحيحة ومحدثة تتعلق بأهدافه ومستواه الرياضي وأي معلومات أخرى يطلب منه تقديمها.
يجب على المستخدم مراعاة قدراته البدنية واتباع تعليمات السلامة أثناء ممارسة التمارين.
لا تشكل البرامج أو التوصيات أو المعلومات الرياضية المقدمة من خلال 7FITNESS تشخيصًا طبيًا أو علاجًا أو بديلًا عن استشارة الطبيب أو المختص الصحي المرخص.
إذا كان لدى المستخدم حالة صحية أو إصابة أو قيود بدنية أو أي سبب قد يؤثر في قدرته على ممارسة النشاط البدني، فعليه استشارة المختص الصحي المناسب قبل ممارسة التمارين.
يحق لـ 7FITNESS تعديل أو تحديث البرامج والمحتوى الرياضي بما يتناسب مع تطوير الخدمات.

ثامنًا: البيانات الصحية وبيانات اللياقة

قد تتيح بعض خدمات 7FITNESS للمستخدم إدخال أو ربط بيانات متعلقة باللياقة أو النشاط البدني أو الصحة، وذلك وفق الخدمات والخصائص التي يختار المستخدم تفعيلها.
تخضع معالجة البيانات الشخصية والبيانات الصحية أو الحساسة لسياسة الخصوصية الخاصة بـ 7FITNESS والأنظمة واللوائح المعمول بها.
في الحالات التي تتطلب موافقة مستقلة أو صريحة على معالجة بيانات معينة، يتم الحصول على تلك الموافقة وفق المتطلبات النظامية.
يجوز للمستخدم التحكم في الأذونات التي يمنحها للخدمات الخارجية المرتبطة بتطبيق 7FITNESS، متى كانت هذه الخاصية متاحة.
لا يجوز للمستخدم إدخال بيانات صحية أو شخصية تخص شخصًا آخر إلا إذا كان مخولًا نظامًا بذلك.

تاسعًا: التكامل مع الأجهزة والتطبيقات الخارجية

قد تتيح 7FITNESS ربط خدماتها ببعض الأجهزة أو التطبيقات أو المنصات الخارجية الخاصة باللياقة أو الصحة ويخضع استخدام هذه الخدمات كذلك للشروط وسياسات الخصوصية الخاصة بالجهة الخارجية، ولا تتحمل 7FITNESS مسؤولية أي تغيير أو توقف أو خلل في خدمة خارجية لا تخضع لسيطرتها ويجوز للمستخدم إلغاء الأذونات الممنوحة لهذه الخدمات من خلال إعدادات الجهاز أو التطبيق أو الخدمة الخارجية بحسب آلية كل خدمة.

عاشرًا: المحتوى الذي يقدمه المستخدم

عند قيام المستخدم بعد موافقة 7FITNESS بإرسال أو رفع أو نشر أي محتوى من خلال خدمات 7FITNESS، فإنه يقر بأنه:

يملك الحق النظامي في تقديم المحتوى واستخدامه.
لا يتضمن المحتوى أي انتهاك لحقوق الملكية الفكرية أو الخصوصية أو أي حقوق أخرى للغير.
لا يتضمن المحتوى أي مادة مخالفة للأنظمة أو مسيئة أو تشهيرية أو تهديدية أو احتيالية.
لا يجوز استخدام الخدمات لنشر إعلانات أو محتوى تجاري أو ترويجي غير مصرح به.
يحتفظ المستخدم بملكية المحتوى الذي يقدمه، مع منح 7FITNESS -بالقدر اللازم لتشغيل الخدمة- الحق في استضافة المحتوى وتخزينه ومعالجته وعرضه ضمن نطاق الخدمة التي قدم من خلالها، وبما لا يتعارض مع الأنظمة المرعية المعمول بها بالمملكة العربية السعودية.
يحق لـ 7FITNESS إزالة أو تقييد المحتوى المخالف لهذه الشروط أو الأنظمة، واتخاذ الإجراءات المناسبة بشأنه.

الحادي عشر: الملكية الفكرية

جميع حقوق الملكية الفكرية المتعلقة بعلامة 7FITNESS وموقعها وتطبيقاتها وتصاميمها وشعاراتها ومحتواها وبرامجها وقواعد بياناتها وموادها التدريبية وواجهاتها ومحتوياتها الرقمية مملوكة لـ 7FITNESS أو مرخصة لها.
لا يمنح استخدام الخدمات المستخدم أي حق ملكية أو ترخيص غير منصوص عليه صراحة في هذه الشروط.
لا يجوز نسخ أو تعديل أو إعادة إنتاج أو توزيع أو نشر أو بيع أو استغلال أي جزء من الخدمات أو محتواها دون موافقة كتابية مسبقة.
لا يجوز استخدام اسم 7FITNESS أو شعارها أو علاماتها التجارية بطريقة توحي بوجود علاقة أو اعتماد أو شراكة غير موجودة.
تحتفظ 7FITNESS بحقوقها النظامية تجاه أي استخدام غير مصرح به لحقوق الملكية الفكرية.

الثاني عشر: الإشعارات والتواصل

يجوز لـ 7FITNESS التواصل مع المستخدم من خلال البريد الإلكتروني أو الرسائل النصية أو الإشعارات داخل التطبيق أو أي وسيلة تواصل يقدمها المستخدم.

وقد تتضمن الرسائل:

إشعارات الحساب.
تأكيدات الاشتراك والشراء.
الفواتير والمدفوعات.
التنبيهات الأمنية.
تحديثات الخدمة.
التذكيرات المتعلقة بالعضوية.
الإشعارات القانونية أو التشغيلية.
العروض والمواد التسويقية وفقًا للأنظمة والموافقات المطلوبة.

الثالث عشر: العروض والمسابقات والبرامج الترويجية

قد تقدم 7FITNESS من وقت لآخر عروضًا أو خصومات أو مسابقات أو مكافآت أو برامج ترويجية.

وتخضع كل مبادرة لشروطها الخاصة، ويجوز تحديد مدة العرض أو عدد المستفيدين أو شروط الأهلية أو المنتجات والخدمات المشمولة فيه.

وفي حال وجود تعارض بين الشروط العامة وهذه الشروط الخاصة، تطبق الشروط الخاصة بالعرض في حدود موضوعه.

الرابع عشر: الإجراءات الوقائية وتعليق الحساب

يحق لـ 7FITNESS، وفقًا لطبيعة المخالفة وبما يتفق مع الأنظمة المعمول بها، اتخاذ الإجراءات المناسبة عند مخالفة المستخدم لهذه الشروط، ومن ذلك:

تعليق الحساب أو العضوية مؤقتًا أو إنهاؤها.
تقييد الوصول إلى بعض الخدمات.
إزالة المحتوى المخالف.
رفض أو إيقاف أي استخدام غير مشروع للخدمات.
اتخاذ الإجراءات النظامية أو إبلاغ الجهات المختصة عند وجود ما يستوجب ذلك نظامًا.
المطالبة بالتعويض عن الأضرار التي ثبت نظامًا تسبب المستخدم فيها نتيجة مخالفته لهذه الشروط.

ولا يخل اتخاذ أي إجراء من الإجراءات السابقة بحق 7FITNESS في اتخاذ أي إجراء نظامي آخر.

الخامس عشر: الروابط والخدمات التابعة للغير

قد تتضمن خدمات 7FITNESS روابط أو تكاملات أو خدمات تقدمها جهات خارجية ولا يعني توفير هذه الروابط أو التكاملات أن 7FITNESS تتبنى أو تضمن محتوى أو خدمات تلك الجهات، وتخضع الخدمات الخارجية لشروط وسياسات الجهات المقدمة لها.

السادس عشر: حدود المسؤولية

تبذل 7FITNESS جهودًا لتوفير الخدمات بصورة مستقرة وآمنة، إلا أن بعض الخدمات قد تتأثر بأسباب خارجة عن السيطرة، بما في ذلك أعطال الشبكات أو الأنظمة أو مزودي الخدمات أو أعمال الصيانة أو الظروف الطارئة وبقدر ما يسمح به النظام، لا تكون 7FITNESS مسؤولة عن الأضرار أو الخسائر الناتجة مباشرة عن:

استخدام المستخدم للخدمات بطريقة مخالفة لهذه الشروط.
المعلومات غير الصحيحة أو غير المكتملة التي يقدمها المستخدم.
الأعطال أو الانقطاعات الناتجة عن أطراف أو خدمات خارج نطاق سيطرة 7FITNESS.
استخدام المستخدم لأجهزة أو تطبيقات أو خدمات خارجية مرتبطة بالخدمة.
فقدان بيانات الدخول أو تمكين الغير منها بسبب تقصير المستخدم.

السابع عشر: مسؤولية المستخدم عن الأضرار

يتحمل المستخدم المسؤولية عن أي ضرر أو مطالبة أو خسارة تلحق بـ 7FITNESS نتيجة مخالفة المستخدم لهذه الشروط أو الأنظمة، وذلك في حدود ما يثبت نظامًا من مسؤولية المستخدم عن تلك الأضرار ولا يشمل ذلك الحالات التي لا يكون المستخدم مسؤولًا عنها نظامًا.

الثامن عشر: أمن المعلومات

تتخذ 7FITNESS التدابير التقنية والتنظيمية والإدارية المناسبة لحماية الخدمات والبيانات وفقًا للمتطلبات النظامية، ومع ذلك لا يمكن ضمان أن تكون أي وسيلة إلكترونية آمنة بصورة مطلقة، ولذلك يلتزم المستخدم باتخاذ التدابير المناسبة لحماية جهازه وبيانات الدخول الخاصة به وعدم مشاركتها مع الغير.

التاسع عشر: سياسة الخصوصية

تخضع معالجة البيانات الشخصية للمستخدم لسياسة الخصوصية الخاصة بـ 7FITNESS، والتي تعد جزءًا مكملًا لهذه الشروط والأحكام.

وتوضح سياسة الخصوصية أنواع البيانات التي قد يتم جمعها، وطرق جمعها، وأغراض المعالجة، والأسس النظامية للمعالجة، وحقوق صاحب البيانات، وطرق ممارسة تلك الحقوق.

وفي حال كانت معالجة معينة تتطلب موافقة مستقلة أو صريحة، فلا يُفهم من قبول هذه الشروط وحده أنه يمثل تلك الموافقة.

العشرون: التعديلات على الشروط والأحكام

يجوز لـ 7FITNESS تحديث أو تعديل هذه الشروط من وقت لآخر نتيجة لتطوير الخدمات أو تغيير المتطلبات التشغيلية أو النظامية.

وتنشر النسخة المحدثة عبر القنوات الرقمية المناسبة، ويكون تاريخ آخر تحديث الموضح في أعلى هذه الوثيقة هو التاريخ المعتمد للنسخة المنشورة.

وفي حال كان التعديل جوهريًا، تتخذ 7FITNESS الإجراءات المناسبة للإشعار.

ويعد استمرار المستخدم في استخدام الخدمات بعد سريان التعديل موافقة على الشروط المحدثة، بالقدر الذي يسمح به النظام.

الحادي والعشرون: القوة القاهرة والظروف الخارجة عن السيطرة

لا تتحمل 7FITNESS المسؤولية عن التأخير أو عدم القدرة على تقديم الخدمة إذا كان ذلك ناتجًا عن ظروف خارجة عن السيطرة المعقولة، بما في ذلك الكوارث الطبيعية أو الأعطال واسعة النطاق أو انقطاع الخدمات الأساسية أو الهجمات الإلكترونية أو القرارات أو الإجراءات الحكومية أو أي ظرف آخر يستحيل أو يتعذر معه تنفيذ الالتزام بصورة معقولة، وذلك بالقدر الذي تقرره الأنظمة المعمول بها.

الثاني والعشرون: قابلية فصل الأحكام

إذا تبين أن أي حكم من أحكام هذه الشروط غير نافذ أو غير قابل للتطبيق وفقًا للأنظمة المعمول بها، فلا يؤثر ذلك على نفاذ بقية الأحكام، ويُفسر الحكم المتأثر بالقدر الذي يجعله متوافقًا مع النظام متى كان ذلك ممكنًا.

الثالث والعشرون: عدم التنازل

عدم ممارسة 7FITNESS لأي حق من حقوقها الواردة في هذه الشروط في وقت معين لا يعد تنازلًا عن ذلك الحق، ولا يمنعها من ممارسته لاحقًا.

الرابع والعشرون: النظام الواجب التطبيق والاختصاص

تخضع هذه الشروط والأحكام وتفسر وفق الأنظمة واللوائح المعمول بها في المملكة العربية السعودية وفي حال نشوء أي نزاع يتعلق باستخدام الخدمات أو تفسير هذه الشروط، يسعى الأطراف إلى معالجته وديًا متى كان ذلك ممكنًا، وفي حال تعذر التسوية الودية، يكون الاختصاص للجهة القضائية المختصة وفق قواعد الاختصاص المقررة نظامًا.

Introduction

Welcome to 7FITNESS

These Terms and Conditions govern your use of the 7FITNESS website, mobile applications, digital platforms, services, programs, memberships, facilities, and any other services, products, or features provided by 7FITNESS through its various channels.

By using any of the 7FITNESS services, registering an account, subscribing to a membership, purchasing a product or service, or benefiting from any available features, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions, as well as the applicable 7FITNESS Privacy Policy, to the extent that it does not conflict with the applicable laws and regulations in the Kingdom of Saudi Arabia. In the event that you do not agree to any of these terms, you must refrain from using or benefiting from the services. Acceptance of these terms does not imply a waiver of any rights granted to the user or consumer under the applicable regulations.

First: Definitions

For the purposes of these Terms and Conditions, the following words and phrases shall have the meanings set forth opposite each of them, unless the context requires otherwise:

7FITNESS: The trademark and operating entity for its affiliated services, products, programs, and platforms.
Services: All services, programs, memberships, features, products, content, and characteristics provided by 7FITNESS through its website, applications, facilities, or any digital or operational channel belonging to it.
User: Every person who uses the 7FITNESS website, application, or services, whether registered or unregistered.
Member: A user who has registered or subscribed to one of the memberships or programs offered by 7FITNESS.
Account: The user's electronic account registered with 7FITNESS.
Content: Text, images, videos, designs, training materials, programs, information, data, and any other materials displayed or made available through the Services.

Second: Eligibility and Use of Services

To use the Services, the user must satisfy the legal capacity required to enter into this agreement.

7FITNESS services are available to individuals aged 16 years and above. Individuals under the age of 16 may use 7FITNESS services with the consent of their parent or legal guardian, in accordance with the applicable laws and regulations.

The user undertakes to provide true, accurate, and updated data upon registration, subscription, or use of the Services.

The user bears the responsibility for maintaining the confidentiality of their account login credentials and assumes liability for any use conducted through their account, unless it is proven that the use occurred due to a cause beyond their control.

The user may not create an account in the name of another person, impersonate any person or entity, or claim a relationship, representation, or affiliation with 7FITNESS without authorization.

The user may not enable another person to use their membership or account if the membership is personal or non-transferable.

7FITNESS reserves the right to take necessary actions upon discovering unauthorized use of the account or membership, or a violation of these Terms.

Third: Acceptable Use

The user undertakes to use the Services in a lawful and compliant manner, and is strictly prohibited from:

Using the Services for any illegal purpose or in violation of the applicable laws and regulations in the Kingdom of Saudi Arabia.
Entering or publishing incorrect, misleading, or impersonated information.
Misusing the Services, or attempting to disrupt them or affect their performance or security.
Attempting unauthorized access to user accounts, systems, servers, or databases belonging to 7FITNESS.
Using automated software, tools, or technical means to extract, copy, or gather content or data from the Services without prior written consent from 7FITNESS.
Copying, republishing, distributing, or commercially exploiting 7FITNESS content without obtaining prior approval.
Publishing or uploading any content that includes defamation, threats, abuse, incitement, violation of third-party rights, or non-compliance with regulations.
Using the Services in a manner that may cause harm to 7FITNESS, its users, employees, partners, or any other party.
Attempting to bypass any technical or security measures established by 7FITNESS to protect the Services or users.
Using the Services or the content available through them to provide competing services, resell, or commercially exploit them without written consent.

Fourth: Memberships and Subscriptions

Memberships and subscriptions are subject to the prices, benefits, durations, and terms specified to the user at the time of subscription.

The membership or subscription term begins on the activation date specified upon completing the subscription process, unless indicated otherwise.

Memberships are personal and may not be transferred, sold, or shared with others, unless explicitly permitted by 7FITNESS.

Membership and program benefits may vary depending on the type of subscription, packages, and available offers.

7FITNESS may offer temporary promotions, benefits, or promotional programs in accordance with the terms specific to each offer.

Offers or discounts may not be combined unless the terms of the offer explicitly state so.

The expiration or cancellation of a membership does not automatically entitle the user to a refund of all amounts paid. Cancellation and refund processes are subject to the terms announced upon purchasing the service and relevant regulations.

If the membership is subject to automatic renewal, the user will be notified thereof upon subscription, and the renewal and cancellation mechanism outlined in the service shall apply.

Fifth: Payments, Prices, and Taxes

The user undertakes to pay the value of the services, products, or memberships according to the prices announced at the time of completing the purchase.

All prices are in Saudi Riyals (SAR), and it will be clarified to the user whether the prices include Value Added Tax (VAT) or otherwise, or any other fees, in accordance with regulatory requirements.

Payment transactions are executed through the payment methods available and approved by 7FITNESS or payment service providers.

7FITNESS bears no responsibility for any payment failure attributable to the bank, payment service provider, or payment method used by the user, provided that it is beyond the control of 7FITNESS.

7FITNESS reserves the right to update future prices, packages, or benefits, provided that new prices apply to subsequent purchases or renewals, unless regulations require otherwise.

Tax invoices and documents are issued in accordance with the regulatory requirements applicable in the Kingdom of Saudi Arabia.

Sixth: Cancellation and Refunds

Cancellations of memberships, subscriptions, and services, as well as refunds, are subject to the declared policy of each service and the relevant statutory laws and regulations.

Where the user possesses a statutory right to cancel or obtain a refund, these Terms shall not affect that right.

If the service has commenced at the user's request prior to the expiration of the legally prescribed cooling-off or cancellation period, statutory provisions regarding services that have commenced performance may apply, depending on the nature of the service.

Due refunds—if any—shall be remitted via the original payment method or any other available method in accordance with approved procedures.

Processing a refund—if applicable—may take a period of no less than fifteen (15) days due to banking or payment service provider procedures.

Seventh: Sports Services and Training Programs

7FITNESS provides programs, content, and services related to physical fitness, exercise, and physical activity according to the nature of each service.

Certain services may include programs, recommendations, or content customized based on the information provided by the user or data permitted to be collected and processed.

The user assumes responsibility for providing correct and updated information regarding their athletic goals, fitness level, and any other information requested from them.

The user must consider their physical capabilities and adhere to safety instructions while exercising.

The programs, recommendations, or athletic information provided through 7FITNESS do not constitute a medical diagnosis, treatment, or a substitute for consulting a doctor or a licensed health professional.

If the user has a medical condition, injury, physical restriction, or any condition that may affect their ability to engage in physical activity, they must consult an appropriate healthcare professional before exercising.

7FITNESS reserves the right to modify or update sports programs and content in line with service developments.

Eighth: Health and Fitness Data

Certain 7FITNESS services may allow the user to input or link data related to fitness, physical activity, or health, subject to the services and features the user chooses to enable.

The processing of personal data, as well as health or sensitive data, is subject to the 7FITNESS Privacy Policy and applicable laws and regulations.

In cases where separate or explicit consent is required for processing specific data, such consent shall be obtained in accordance with regulatory requirements.

The user may control the permissions granted to external services linked to the 7FITNESS application whenever this feature is available.

The user may not input health or personal data belonging to another person unless legally authorized to do so.

Ninth: Integration with External Devices and Applications

7FITNESS may allow its services to be linked with certain external devices, applications, or platforms related to fitness or health. The use of these services is likewise subject to the terms and privacy policies of the third party. 7FITNESS bears no responsibility for any alteration, interruption, or malfunction in an external service outside its control. The user may revoke permissions granted to these services through the settings of the device, application, or external service according to each service's mechanism.

Tenth: User-Provided Content

When the user submits, uploads, or publishes any content through 7FITNESS services following approval from 7FITNESS, the user represents and warrants that:

They hold the legal right to provide and use the content.
The content does not involve any violation of intellectual property rights, privacy, or any other third-party rights.
The content does not contain any material that violates regulations, or is offensive, defamatory, threatening, or fraudulent.
The Services may not be used to publish unauthorized advertisements, commercial content, or promotional material.
The user retains ownership of the content they submit, while granting 7FITNESS—to the extent necessary to operate the service—the right to host, store, process, and display the content within the scope of the service through which it was provided, and in a manner that does not conflict with applicable laws in the Kingdom of Saudi Arabia.
7FITNESS reserves the right to remove or restrict content that violates these Terms or regulations, and to take appropriate measures regarding it.

Eleventh: Intellectual Property

All intellectual property rights related to the 7FITNESS brand, website, applications, designs, logos, content, software, databases, training materials, interfaces, and digital content are owned by or licensed to 7FITNESS.
Use of the Services does not grant the user any ownership right or license not expressly provided for in these Terms.
No part of the Services or their content may be copied, modified, reproduced, distributed, published, sold, or exploited without prior written consent.
The 7FITNESS name, logo, or trademarks may not be used in a manner that implies an unestablished relationship, endorsement, or partnership.
7FITNESS reserves its legal rights against any unauthorized use of its intellectual property rights.

Twelfth: Notifications and Communication

7FITNESS may communicate with the user via email, SMS, in-app notifications, or any communication method provided by the user.

Messages may include:

Account notifications.
Subscription and purchase confirmations.
Invoices and payments.
Security alerts.
Service updates.
Membership reminders.
Legal or operational notices.
Offers and marketing materials in accordance with regulations and required consents.

Thirteenth: Offers, Competitions, and Promotional Programs

7FITNESS may from time to time offer promotions, discounts, competitions, rewards, or promotional programs.

Each initiative is subject to its own terms, and the offer duration, number of beneficiaries, eligibility criteria, or included products and services may be specified.

In the event of a conflict between the general terms and these specific terms, the terms specific to the offer shall apply within the scope of its subject matter.

Fourteenth: Preventive Measures and Account Suspension

7FITNESS reserves the right, depending on the nature of the violation and in accordance with applicable laws, to take appropriate actions upon a user's violation of these Terms, including:

Temporarily suspending or terminating the account or membership.
Restricting access to certain services.
Removing violating content.
Refusing or halting any unlawful use of the Services.
Taking legal action or notifying competent authorities when legally required.
Demanding compensation for damages legally proven to have been caused by the user as a result of violating these Terms.

Taking any of the aforementioned measures does not prejudice the right of 7FITNESS to take any other legal proceedings.

Fifteenth: Third-Party Links and Services

7FITNESS services may contain links, integrations, or services provided by third parties. Providing these links or integrations does not imply that 7FITNESS endorses or guarantees the content or services of those parties. External services are subject to the terms and policies of their respective providers.

Sixteenth: Limitation of Liability

7FITNESS endeavors to provide services in a stable and secure manner; however, certain services may be affected by factors beyond control, including network or system failures, service provider outages, maintenance work, or emergency circumstances. To the extent permitted by law, 7FITNESS shall not be liable for damages or losses resulting directly from:

The user's use of the Services in violation of these Terms.
Incorrect or incomplete information provided by the user.
Outages or disruptions caused by third parties or services outside the control of 7FITNESS.
The user's use of external devices, applications, or services linked to the service.
Loss of login credentials or enabling third parties to access them due to user negligence.

Seventeenth: User Liability for Damages

The user shall be liable for any damage, claim, or loss incurred by 7FITNESS as a result of the user's violation of these Terms or regulations, within the limits of what is legally established regarding the user's responsibility for such damages. This does not include cases where the user is not legally responsible.

Eighteenth: Information Security

7FITNESS implements appropriate technical, organizational, and administrative measures to protect services and data in accordance with regulatory requirements. However, no electronic means can be guaranteed to be absolutely secure; therefore, the user undertakes to take appropriate measures to protect their device and login data and refrain from sharing them with third parties.

Nineteenth: Privacy Policy

The processing of the user's personal data is subject to the 7FITNESS Privacy Policy, which forms an integral part of these Terms and Conditions.

The Privacy Policy clarifies the types of data that may be collected, collection methods, processing purposes, legal bases for processing, data subject rights, and methods for exercising those rights.

Where specific processing requires separate or explicit consent, acceptance of these Terms alone shall not be construed as constituting such consent.

Twentieth: Amendments to Terms and Conditions

7FITNESS may update or amend these Terms from time to time as a result of service developments or changes in operational or regulatory requirements.

The updated version will be published via appropriate digital channels, and the "Last Updated Date" shown at the top of this document shall be the recognized date for the published version.

In the event of a material amendment, 7FITNESS will take appropriate measures to give notice.

The user's continued use of the Services after the amendment takes effect constitutes acceptance of the updated terms, to the extent permitted by law.

Twenty-First: Force Majeure and Circumstances Beyond Control

7FITNESS shall not be held liable for delay or inability to perform the service if resulting from circumstances beyond reasonable control, including natural disasters, widespread outages, essential service disruptions, cyberattacks, government decisions or measures, or any other circumstance that renders performance reasonably impossible or impracticable, to the extent determined by applicable laws.

Twenty-Second: Severability

If any provision of these Terms is held to be invalid or unenforceable under applicable laws, such invalidity shall not affect the enforceability of the remaining provisions, and the affected provision shall be interpreted to the extent that makes it compliant with the law whenever possible.

Twenty-Third: Non-Waiver

The failure of 7FITNESS to exercise any of its rights under these Terms at any given time shall not constitute a waiver of that right, nor shall it prevent 7FITNESS from exercising it subsequently.

Twenty-Fourth: Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia. In the event of any dispute arising in connection with the use of the Services or the interpretation of these Terms, the parties shall endeavor to resolve it amicably whenever possible. If an amicable settlement cannot be reached, jurisdiction shall belong to the competent judicial authority in accordance with statutory jurisdiction rules.
